Mr. Coyne shared several examples of how Blaine's support helped the school district and acknowledged him by presenting a plaque. Bob Pence representing Congresswoman Grace Napolitano's office, recognized Blaine's commitment to public service, acknowledged his steady leadership and ease of working with people. Matt Lyons representing Assembly Member Chris Holden's office congratulated Blaine on his retirement and presented him with a certificate of recognition. He complimented Blaine on his calm demeanor, his speech on volunteerism and his words shared with the students at the Students in Government Day. ORAL COMMUNICATIONS (Members of the audience are invited to address the City Council on any item not on the agenda. Under the provisions of the Brown Act, the legislative body is prohibited from taking or engaging in discussion on any item not appearing on the posted agenda. However, your concerns may be referred to staff or set for discussion at a later date. If you desire to address the City Council on an item on this agenda, other than a scheduled public hearing item you may do so at this time and ask to be heard when that agenda item is City Council Minutes Page 2 April 23, 2018 considered. Comments on public hearing items will be considered when that item is scheduled for discussion. The Public Comment period is limited to 30 minutes. Each speaker shall be limited to three (3) minutes.) a. Members of the Audience Alline Kranzer resident made announcements of events and activities within the city. Yesnia Arias representing the Foothill Gold Line Construction Authority announced upcoming testing of the underground communication system on April 28, 2019. The testing will affect some crossings in San Dimas. She thanked Blaine for his professionalism and ease of communicating. Nora Chen San Dimas Library Manager, announcements of upcoming activities and events at the library. Isabel Arrastia Ebiner resident shared her concerns regarding recent criminal activity in her neighborhood and asked that information from the Sheriff s Department is shared with the community. Captain Berg with the San Dimas Sheriff s Station reported that the Sheriff s Department is aware of the residents' concerns and the department is actively following up on leads with these cases and not able to reveal many details at this time. He added that additional funding has allowed the department to add additional patrols in the area. CONSENT CALENDAR (All items on the Consent Calendar are considered to be routine and will be enacted by one motion unless a member of the City Council requests separate discussion.) Resolutions read by title, further reading waived, passage and adoption recommended as follows: a) RESOLUTION 2019-20, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN DIMAS APPROVING CERTAIN DEMANDS FOR THE MONTH OF APRIL 2019. b) Approval of minutes for the March 12, 2019 and March 26, 2019 City Council meetings. c) Award of Construction Contract 2019-03 — Monte Vista Apartment HVAC Replacement to NKS Mechanical Contracting, Inc. in the amount of $85,000. d) Award Construction Contract No. 2019-01 Rennell Et Al Improvement Project to Construction Contract to Onyx Paving Company, Inc. for the bid amount of $437,000.00; and approval of Project Budget of $554,400.00 which includes the construction contract, 20% contingency, geotechnical testing a survey. e) Approval to enter into proposed City of San Dimas Cooperative Agreement with the County of Los Angeles Department of Public Works for the Badillo ET Al., Road Improvement Project. Pursuant to CEQA Categorical Exemption per City Council Minutes April 23, 2018 Page 3 Section 15301(c) and 15304 (b), find this road improvement project is categorically exempt from the provisions of CEQA. f) Deny Claim for Moyer vs. City of San Dimas (1992655 CBV) RECOMMENDED ACTION: Approve consent calendar as presented. YES: Badar, Berton, Morris, Vienna NOES: None ABSENT: Ebiner ABSTAIN: None PUBLIC HEARING Establishment of Sewer Reimbursement District de Anza Heights Drive RECOMMENDED ACTION: Approve the establishment of the De Anza Heights Sewer Reimbursement District on behalf of the homeowners at 416 De Anza Heights to recover the sewer construction costs and; approve the De Anza Heights Sewer Reimbursement District agreement. Director of Public Works Krishna Patel presented staff s report on this item. Mayor Morris opened the public hearing for comments from members of the audience. Responding to Council Member Berton, Assistant City Manager of Community Development Larry Stevens replied a resident would be required to hook up to the system if their existing private disposal sewer systems failed and the sewer line was within two hundred feet or if an addition triggered an increase in use of the system. Responding to Council Member Badar Director of Public Works Krishna Patel explained that if no other homeowners connect to the sewer system the originating homeowner would be out the whole amount of establishing the system. Mayor Morris opened the public hearing for comments. Homeowner Tom Yu asked if they were to build on their property and no one else connects to the system are they on responsible only for their prorated share. Mr. Patel answered yes they would only be responsible for their share plus the cost of sanitation fees. Discussion was had on the options for homeowners to connect or not to the system. City Council Minutes Page 4 April 23, 2018 Assistant City Manager Larry Stevens responded that owners within 200 feet of the system who develop their property would be required to hook up and would not be able to legally establish a private system. He added that if there were no sewer reimbursement district they would pay a normal connection fee, if there is a district they would pay the reimbursement amount plus the normal connection fees. Mayor Morris closed the public hearing and brought the item back to the council for discussion and vote. City Attorney Jeff Malawy shared that a discrepancy was found between the chart in the agreement and the chart attached to the staff report; the allocations among the property are different. The chart attached to the staff report is the correct one and the motion should include an amendment to the agreement to add the chart from attachment b of the staff report. Mr. Stevens and Mr. Patel provided additional clarification to the Council for reasons of establishing the reimbursement district and provided an explanation on the concept behind doing the reimbursement. MOTION: Motion/seconded by Councilmembers Berton/Vienna to approve the establishment of the reimbursement district. The motion passed by 4-0 vote. Bonita Avenue Assistant City Manager Ken Duran presented staff s report on this item. Resident Pete Sluis shared data and information on the Metro Link double track project. City Manager Mayor's call in show will air Thursday, April 25, 2019. City Attorney Offered his congratulations to Mr. Michaelis on his retirement. Members of the City Council Appointments to the Equestrian Commission MOTION: Motion/seconded by Mayor Pro Tem Vienna/Bertone to appoint Renee Cravins and Rosalba Santana to the Equestrian Commission. Motion passed by 4-0 vote. YES: B adar, B ertone, Morris, Vienna NOES: None ABSENT: Ebiner ABSTAIN: None Councilmembers' report on meetings attended at the expense of the local agency. Councilmember Bertone reported that he attended a conference sponsored by the San Gabriel Valley Council of Governments. Individual Members' comments and updates: Councilmember Vienna comments/requests • Acknowledgement of staff and volunteers for their involvement in the Easter event festivities • Addressed a Nextdoor posting's representation of the Easter event • Acknowledgement of the Earth Day event • Announcement of the Crime Survivors event at B onelli Park • Attendance at Supervisor Barger's annual event • Expressed thanks for City Manager Michaelis' ability to maintain a calm and cool demeanor; and offered his apology for some of the contentious occasions City Council Minutes April 23, 2018 Page 6 Councilmember Badar comments/requests: Acknowledgement of the local businesses and HEROES organization for the Easter event Shared the memory of Blaine's participation at his own retirement and expressed his thanks for all that he has done for the city. Councilmember Bertone comments/requests: Announcement of the upcoming Festival of Arts Acknowledged Blaine's positive management style of running the city, interacting with Council, residents and the employees. Mayor Morris comments Shared that the city's selection of Blaine for City Manager was the opportunity for the city to have someone really special join the city and his has done a phenomenal job. City Manager Blaine Michaelis expressed his gratefulness for the kind words and relationships with everyone tonight. He shared the story of his start into public service. He thanked everyone for being a part of shaping the quality of life in San Dimas and expressed his appreciation to all the other cities, agencies and associations that he has worked with during his career. He thanked his family for their support through the years.
