Vienna (absent) STAFF: City Manager Blaine Michaelis Assistant City Manager Ken Duran Assistant City Manager Community Development Larry Stevens Engineering Manager Shari Garwick Director of Parks and Recreation Hector Kistemann CALL TO ORDER Mayor Morris called the meeting to order at 7:00 p.m. and led the flag salute. City Manager Michaelis commented that Councilmember Denis Bertone's wife Diana, passed away this afternoon and he will not be at the meeting. He added that Councilmember Ryan Vienna is fulfilling his obligations with the Sheriff's Department in response to the local wildfires and also will not be at the meeting. ORAL COMMUNICATIONS (Members of the audience are invited to address the City Council on any item not on the agenda. Under the provisions of the Brown Act, the legislative body is prohibited from taking or engaging in discussion on any item not appearing on the posted agenda. However, your concerns may be referred to staff or set for discussion at a later date. If you desire to address the City Council on an item on this agenda, other than a scheduled public hearing item you may do so at this time or asked to be heard when that agenda item is considered. Comments on public hearing items will be considered when that item is scheduled for discussion. The Public Comment period is limited to 30 minutes. Each speaker shall be limited to three (3) minutes.) Members of the Audience 1. Steve Kafroff— Field Director for state and county municipal employees union who represents LA County Sanitation District employees. He discussed the District City Council Minutes November 13, 2018 Page 2 employee's labor negotiations with the District and concerns with pension obligations and asked the Council and Mayor to help resolve this issue. 2. Danielle Morezio — A former San Dimas resident and Sanitation District employee. She commented that Mayor Morris is a member of the Districts Personnel Committee and has declined to meet with the union to resolve their contract issues. 3. Jeff Valdez — San Dimas resident and Sanitation District employee. He stated that the union has communicated to Mayor Morris to meet with them to discuss the labor dispute and he has stated that he is too busy and not a part of the process. Mayor Morris commented that he never said either of those two comments. He added that he does not feel it is appropriate for a member of the Personnel Committee to meet directly with the union that there is a labor negotiation process and that is not the process. 4. Bo Mena — Employee of the Sanitation District. He stated that Mayor Morris made the statement to him that he is not a part of the negotiation process. Mayor Morris responded that he did not make that statement. He added that he does not feel it is proper for a member of the Personnel Committee to meet directly with the employees. 5. Wendy Guise — Resident. She commented on the overall unfunded pension obligations of government employees and the tax payers should not have to pay for this. She commented that the District employees should not try and bully the Council to have tax payers pay more taxes. CONSENT CALENDAR (All items on the Consent Calendar are considered to be routine and will be enacted by one motion unless a member of the City Council requests separate discussion.) a. Resolutions read by title, further reading waived, passage and adoption recommended as follows: RESOLUTION 2018-59, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN DIMAS, CALIFORNIA, APPROVING CERTAIN DEMANDS FOR THE MONTHS OF OCTOBER AND NOVEMBER 2018 b. Approve minutes for the October 23, 2018 City Council Housing Authority meeting. c. Election for WQA Board Member Representing Cities without Water Pumping Rights d. San Gabriel Valley Council of Governments Valley Voice Article e. Approval of the City's Annual Independent Audited Financial Statements RECOMMENDATION: Accept and approve these statements as the Annual Report by minute action. City Council Minutes November 13, 2018 Page 3 END OF CONSENT CALENDAR MOTION: Motion/second by Councilmembers Badar/Ebiner to approve the consent calendar as presented. The motion passed with a vote of (3-0) YES: Badar, Ebiner, Morris NOES: None ABSENT: Bertone, Vienna ABSTAIN: None OTHER BUSINESS Waste Management Rate Increase Request RECOMMENDATION: Approve the 3.43% rate increase for residential and commercial services as requested by Waste Management effective January 2, 2019. Staff also recommends approval of the Saturday Premium Service Rate. Mr. Duran reviewed his staff report regarding the proposed rate increase for residential and commercial refuse rates from Waste Management. He also presented Waste Managements proposed new premium rate for Saturday commercial service. Mayor Morris asked how much the increase was for the Saturday premium. Mr. Duran responded that it is 2 'h times the daily rate. Teri Muse, representing Waste Management, described the type of customer that requests Saturday service and the rationale for charging a premium for Saturday service. There was discussion by the Council on the premium charge for Saturday service. The consensus of the Council was to table the decision on the Saturday service premium until they have more information. MOTION: Motion/second by Councilmembers Ebiner/Badar to approve the proposed residential and commercial rate increase that is covered by the formula in the Agreement. The motion passed by a vote of (3-0). YES: NOES: ABSENT: ABSTAIN: Gold Line Update Ebiner, Badar, Morris None Bertone, Vienna None Mr. Michaelis reported that the Gold Line Authority has recently announced that the bids for the project extension have come in substantially over budget. He added that the Authority is now considering amending the project to shorten the extension for this phase to terminate in La Verne while they look for funding to complete the project. He added that this will City Council Minutes November 13, 2018 Page 4 shorten the construction schedule by 2 years. He further added that this will require an amendment to the EIR and also a rebid of the project. SAN DIMAS HOUSING AUTHORITY Mr. Michaelis suggested that since Councilmembers Bertone and Vienna are not present this evening these items be held over to the next meeting. The Council concurred to hold over the items to the next meeting. ORAL COMMUNICATIONS Wendy Guise — Thanked Mayor Morris and all of the Council for being valued public servants. Cheryl Mahan - San Dimas One Legacy Ambassador for the City. She invited the Council to attend an event for the One Legacy Rose Parade float and encouraged organ transplant participation. City Manager Mr. Michaelis reported that City Attorney Mark Steres has announced his retirement at the end of the year. He suggested that a special meeting for Monday, November 26 to interview interim City Attorney candidates. The consensus of the Council was that Wednesday, the 28t` or 29th would be available pending the other Councilmembers availability. City Attorney Mr. Steres commented that he has made the decision to retire the end of this year after a long tenure with the City. He also commented that since two Councilmembers are absent this evening the noticed closed session will be continued. Members of the City Council Councilmembers' report on meetings attended at the expense of the local agency No reports. Individual Members' comments and update Councilmember Badar asked for a status report on the San Dimas Ave. project. Mrs. Garwick reported that most of the concrete work has been completed. She commented that the grinding work has begun and that the road should remain open but using a pilot car for traffic.
