DIMAS SAN DIMAS COUNCIL CHAMBER 1960 1 245 EAST BONITA AVENUE THE FEBRUARY 23rd, 2021 CITY COUNCIL MEETING WILL BE CONDUCTED PURSUANT TO THE PROVISIONS OF THE GOVERNOR'S EXECUTIVE ORDER N- 29-20 THE CITY COUNCIL CHAMBERS WILL BE OPEN FOR PUBLIC COMMENT ONLY Pursuant to the Governor's Executive Order dated March 17, 2020, the City Council is authorized to hold public meetings via teleconferencing and to make meetings accessible electronically to all members of the public seeking to observe and to address the legislative body. All Brown Act provisions that require the physical presence of City Councilmembers or the public for City Council meetings are waived. Please review pages five and six of this document for instructions on public participation. Public comment will not be taken during each individual agenda item, except for public hearing items. Comments on public hearing items will be heard when that item is scheduled for discussion. Under the provisions of the Brown Act, the legislative body is prohibited from engaging in discussion on any item not appearing on the posted agenda. However, your concerns may be referred to staff or set for discussion at a later date. CONSENT CALENDAR (All items on the Consent Calendar are considered to be routine and will be enacted by one motion unless a member of the City Council requests separate discussion.) Resolutions read by title, further reading waived, passage and adoption recommended as follows: Approve RESOLUTION 2021-09, for the Warrant Register of February 261", 2021 in the amount of $1,076,779.49. Summary of Senate Bill 9 — Increased Density in Single -Family Zones RECOMMENDATION: Staff recommends that the City Council submit a Letter of Opposition for SB 9. Review and Approve Resolution 2021-10 Adopting a Permit Parking Policy and Parking Permit Fees RESOLUTION 2021-10, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN DIMAS, CALIFORNIA, ESTABLISHING A PERMIT PARKING POLICY AND FEE FOR ISSUANCE OF PARKING PERMITS, PURSUANT TO CHAPTER 10.25 OF THE SAN DIMAS MUNICIPAL CODE San Gabriel Valley Council of Government Updates City Council Minutes February 23rd, 2021 Page 3 Approve Project Change and Execution of new Grant Agreement for Mobile Source Air Pollution Reduction (MSRC) Grant RECOMMENDATION: Staff recommends the City Council authorize the City Manager or his designee to submit the Project Change Request letter and execute the new grant agreement of funding from the MSRC 2017 Local Government Partnership Program, including any and all documents necessary to further the project approved herein, but not limited to amendments and modifications thereto for MSRC projects with the South Coast Air Quality Management District (SCAQMD). END OF CONSENT CALENDAR RECOMMENDATION: Approve consent calendar as presented. Councilmember Ebiner requested Staff provide a brief explanation of item 3B — Senate Bill 9. Planning Manager Fabiola Zelaya Melicher provided the explanation. MOTION: Motion/seconded by Councilmember Vienna/Mayor Pro Tem Berton to approve the consent calendar as presented. Bertone: Yes Ebiner: Yes Vienna: Yes Weber: Yes Badar: Yes OTHER BUSINESS Initiation of a Municipal Code Text Amendment to amend Chapter 18.140 C-G Creative Growth Zone to Allow for formerly Established Second Floor Residential Units in the CG-2 Frontier Village Area to be Reestablished as a Conditional Use RECOMMENDATION: Staff recommends that the City Council initiate a Municipal Code Text Amendment to amend Section 18.140 (C-G Creative Growth Zone) relating specifically to allowing for previously existing residential uses to be reestablished as a conditional use in the Creative Growth, Area 2 — Frontier Village area. Associate Planner Ken Fichtelman presented staff s report on this item. Councilmember Ebiner recused himself from the discussion and vote on this item because of a conflict of interest in owning property within 500 ft of one of the parcels. MOTION: Motion/seconded by Councilmembers BertoneAVeber for Staff to initiate a Municipal Code Text Amendment to amend Section 18.140 (C-G Creative Growth Zone) relating specifically to allowing for previously existing residential uses to be reestablished as a conditional use in the Creative Growth, Area 2 — Frontier Village area. City Council Minutes February 23rd, 2021 Bertone: Yes Ebiner: Abstain Vienna: Yes Weber: Yes Badar: Yes Mid -Year Budget Review and Recommended Budget Amendments Page 4 RECOMMENDATION: Staff recommends the City Council approve the proposed budget amendments in Attachment A which are: • Increase in General Fund budget appropriations by 265,746 which includes a transfer into the Landscape Maintenance fund totaling $20,000, and • Increase in Landscape Maintenance Fund by $19,700. Administrative Services Manager Michael O'Brien presented staff s report on this item. City Manager Chris Constantin outlined some of the concepts of the upcoming budget proposals. MOTION: Motion/seconded by Councilmembers Vienna/Ebiner to approve the proposed budget amendments in Attachment A of the staff report. Motion carried 5-0. Bertone: Yes Ebiner: Yes Vienna: Yes Weber: Yes Badar: Yes COVID-19 City Council Evaluation of Past Meeting Structure including Public Comment Process, and Direction for Any Changes for Future Meetings City Manager Constantin presented staff s report on this item. RECOMMENDATION: The City Manager recommends the City Council provide direction for any future changes, if applicable. Councihnember Ebiner stated there should be more public engagement not less; and the public should be allowed to comment as the items on the agenda are being discussed. Councilmember Bertone stated the current format for oral communication is too restrictive, but does not agree that comments should be allowed as each item is being discussed. He further stated that the format should go back to allowing public comment at the end. Councihnember Vienna stated that many cities are struggling with finding the right balance for public engagement; and noted that San Dimas has expanded the opportunity for the public to engage by adding Zoom and written comments. City Council Minutes February 23rd, 2021 Page 5 Councilmember Weber shared that the feedback he receives is because meetings run so long some residents can't speak on the item they are interested it. He stated that he is not sure revisiting the topic of comments at the beginning or end would address these concerns. He further stated he is okay with giving the current process a little more time. Mayor Badar expressed that this process has not been in effect long enough to evaluate. MOTION: Motion/seconded by Mayor Badar/Councilmember Vienna continue with the current process in.place and evaluate sometime in the future if warranted. Motion carried 3-2. The City Council returned from closed session at 10:21 p.m. The City Attorney announced that Council received a report and gave direction to staff on the closed session item, but no reportable action was taken.
